Your business and the EU Referendum

Find out how the result of the EU Referendum could affect your business activities and what support is available.

Exports

Scotland will continue to be part of the EU Single Market for at least two years. The referendum result will not impact on existing export and import arrangements with the EU and other countries during that time.

Employment

Scotland will continue to be part of the EU Single Market for at least two years. The Referendum result will not impact on existing arrangements on the movement of people with the EU and other countries during that period.

In the longer term, it’s not clear how employment law and regulations for all employees may be impacted. Both migration and employment law are matters reserved to the UK Government

Regulation

The referendum result will not impact on regulations which are the responsibility of the Scottish Government.

This list of some of Scottish regulators shows the range of regulation that impacts businesses in Scotland:

Scotland will continue to be part of the EU Single Market for at least two years. In the longer term, it’s not clear how UK or EU regulations which impact on Scottish business may change.

State Aid

Following the EU referendum result all the UK’s rights and obligations – including consideration of state aid – remain in place.

Any approved aid continues to be monitored by the European Commission.

EU Funding

At present Scotland remains part of the EU and current EU-funding remains in place. All programmes that have been approved by the European Commission up to March 2018 will continue as they do now.

On 13 August the UK Government also confirmed: “structural and investment fund projects signed before the Autumn Statement and Horizon research funding granted before the UK leaves the EU will be guaranteed by the Treasury. The UK government will also match the current level of agricultural funding until 2020”.

Horizon 2020

Horizon 2020 is an EU research and innovation programme. Nearly €80 billion of funding is available through this programme from 2014 to 2020. The result of the EU referendum has no immediate impact if you’re applying to, or participating in, Horizon 2020.

EU Procurement

Scotland continues to be part of the EU Single Market and procurement legislation is not affected by the referendum result.

Scottish businesses have rights and protection under EU procurement law when competing for public and utilities sector contracts elsewhere in the EU. If any of the arrangements for the UK’s exit from the EU impact procurement law, advice will be provided at the earliest opportunity.
